A comparative approach to different regimes of regulating prostitution: What is the most desirable form of managing sex work for Tijuana, Mexico. It is a global phenomenon, which has become a burden on governments, human rights organizations and societies in general.
This study is an attempt to analyze the regimes by which sex work is regulated in different countries and in different States within Mexico. For the particular case of Mexico, commercial sex work or prostitution exists legally but it is a phenomenon with many stereotypes that very few really acknowledge or understand. Governments can no longer afford to think that isolating it to tolerance zones is sufficient. It should remain as a priority in the policy agenda to find the most suitable form of managing CSW in order to diminish or prevent it from acting as a contributing factor to serious negative externalities such as child prostitution, human trafficking, drug related crimes and violence and other human rights violations.
At the same time, it is very important to identify and understand the different types of prostitution and the socioeconomic factors that contribute to the root causes this activity in order to implement a potential managerial system of CSW that best suits the interests of the population and stakeholders. In Mexico, CSW has never been illegal, and these activities date back to prehistoric times2; however, the lack of a Federal Policy and the ambiguity granting States the jurisdiction to act as regulators of prostitution many not being able to harmonize their legal systems with international legal instruments on the matter has proven to be a contributing factor to negative economic and social repercussions.
